Let’s reframe Terms and Conditions as Tender Love & Care!!! Our world is full of regulations as it is!! 

We take pride in our community at KULA BODY and will always do our best for you. We will make every possible effort to deliver classes and services on time as advertised. Like life though sometimes things don’t always go to plan. On rare occasions there may be times when a scheduled class is unable to be delivered due to unforeseen circumstances such as lockdowns and dangerous weather etc.

Classes start on time, please ensure that you arrive at least 5 minutes before the scheduled class. When you arrive at the studio our teachers will be there to welcome you and get you on the mat so you can start to chill from your day. So this can happen, we ask that where possible you please book and pay online before the class starts.  

 

Pilates Reformer Cancellation Policy

In our reformer classes we  have limited our number to 10 as we feel this number is perfect for both individual attention and atmosphere to give you the very best experience. Because we are so good at what we do we sometimes get fully booked. If your fellow friends/students are on the waitlist and you don’t show for class they get super upset cause they feel they miss out. So they don’t shed any tears, we ask that you give us as much notice as possible so we can let them know they can now come. Imagine how excited they will feel!!!

We hate charging anybody any fee for not giving us enough of a heads up that you won’t be making it but to make it fair for all, we do have a late cancellation/ no show policy. If a cancellation is made after 8pm the night before for a morning class that starts before 10am or within 2 hrs of a class that starts on or after 10am on that day, for our intro deal, drop ins and class pass holders, the class will be deducted from your pass as if you had attended and for our members, we may charge you a $15 fee.

If you are on the waitlist, a text or email will be sent if you secure a spot in the class. We assume that you will be attending the class, even if you do NOT respond. Many waitlist confirmations occur overnight so if you decide you don’t want to go to class the next day, please take yourself off the waitlist as you may incur the late charge if you don’t see the text in time! 

If you are on the waitlist and you turn up to class hoping for a spot, it may happen if someone doesn’t turn up. This is rare but can happen in the busy classes. If there is a spare reformer, due to a no show, please wait for 5 minutes into the class and then the teacher can direct you to take that spot. If you are running late for class, once 5 minutes has passed you are forfeiting your place.

 

Class Cancellations

Sometimes we get only one student in a class. This is rare and due mostly to a cyclone or similar. LOL. If this does happen we may ring you and kindly ask if you don’t mind moving to the time slot just before or after the current class. Classes require a minimum of 2 people before they get off to a flying start. 

 

Intro Offers

Our intro offers are only available for you to try all the teachers out on your first visit to the studio. We want you to enjoy the 2 weeks with us. These passes can’t be suspended as they are only for 2 weeks. Any non-cancellations, no show or absence will result in forfeiting that visit. If you do not attend a booked session or cancel outside of our cancellation policy then you will be charged for that class. 

Class Passes

KULA BODY loves you to stay with our brilliant team and so are here to encourage you to continue. If you buy a pass then we would love you to see it through rather than refund it. If you get injured or there is another reason we are happy to transfer your pass to a friend. Imagine how joyous they would be to know that they have the opportunity to become part of the warm and loving community.

Memberships

We love having you part of our community as a member. We have 5 different types of memberships on offer. Your membership will start on the day that you sign up with us. This will also be the start of your billing cycle. We humbly ask you to come to the number of classes on your membership schedule within that week as they don’t rollover into the next week. This will motivate you to come in and stay healthy. No joining fee and no minimum contract period. 

Membership Upgrade/Downgrade

KULA BODY Members are welcome to swap between the membership options. Simply email smile@kulabody.com to upgrade or downgrade your membership. 

 

Membership Payments

When you sign up for a membership with KULA BODY you can opt for your payment to be made via direct debit bank account or credit card. This transaction commences from the day you sign up. Membership payments are deducted fortnightly from the starting date, from your nominated credit or debit card. The memberships do not include access to guest teachers, workshops, retreats, teacher training or other special events. If you wish to go to these events and can’t afford to, please come and talk to us. As a member, we often have special deals for you though!

We know what it’s like when you have emptied out your bank account or the school fees or that last ditch at a holiday. Can you make sure though that you leave some left for your fortnightly auto debit. If any auto debit is declined due to insufficient funds, the transaction will fail which requires additional administration and yields additional bank costs. Unfortunately, our third party biller, Ezidebit, is unable to absorb these costs and applies a fee for these failed transactions. The fee is currently $9.90 but may change from time to time. This fee will be debited from your nominated account after the failed payment. 

Everything keeps going up. Houses, clothes and food!!! Sometimes we need to keep up with the rising costs and will put up the prices over time. We will let you know in advance and if it’s a problem for you, please let us know. 

 

Membership Cancellation & Suspensions

You may suspend your membership at any time with written notice by emailing smile@kulabody.com. The fortnightly payment schedule will be paused during the suspension period and reactivated once the suspension period is completed. 

We’re sure KULA will become your home away from home and we think of you as family. If you have to leave us we will be sad but will wish you an amazing life nevertheless. You may cancel anytime with 14 days written notice by emailing smile@kulabody.com. The 14-day notice period must include one final billing date, and your membership will end at the end of that billing period. You will receive an email confirmation that your membership has been cancelled. If you do not receive a reply within seven days, please contact us again. Please note that we are unable to issue refunds for non-attendance – it is each member’s responsibility to cancel membership when it is no longer required.

Annual Memberships

Annual membership payment is paid up front, in full and is non-refundable. You may suspend your membership for a maximum of 28 days over the 12 month membership period, with written notice by emailing smile@kulabody.com. The expiry date of your pass will automatically be adjusted to cater for the suspension period requested.

The contract can not be cancelled or refunded but can be transferred to someone else for a fee of $150, with written notice by emailing smile@kulabody.com. If you do not receive a reply within seven days, please contact us again to ensure this transfer is completed successfully.

 

Compassionate Memberships

We want everybody to experience our space. If you find yourself without a job and no or little income, come and talk to us as we would love to have you as part of our community. Growing up I was so inspired by my dad who as an orthopedic surgeon often treated patients for free for those who could not afford his services. My dad in his day was one of the top hand surgeons in Newcastle. He tells me many animated stories about his work in the Cook Islands for a community that couldn’t afford a doctor. Following in his footsteps this is something I would love to do for our community. KULA embraces all with open arms. Events & Workshops

When purchasing a ticket to one of our events or workshops, this purchase is final. We get that things change and if you are unable to make it, we are happy for you to transfer your ticket to a family member or friend but unfortunately we are unable to refund! To organise transferring your ticket to a lucky someone else, please email us at smile@kulabody.com.

 

Lost Property

Each week a student will leave their drink bottle with us as a present or as an ornament? Not sure why but nevertheless our lost property basket is overflowing with these goodies. Whilst we truly appreciate your gift, we will keep it for a period of time for you to reclaim before taking them over to the Red Cross. If your bottle or item is a treasured item, please ensure you take it home as we can’t take responsibility for it.  

 

Limited Liability

You acknowledge that KULA BODY staff are not medically trained and are not qualified to assess if you are in good physical condition and can exercise or undertake nutritional programs without risking your health, safety or comfort. You further acknowledge and agree that any dietary or nutritional advice, or physical fitness advice, courses or programs provided by KULA BODY are for informational and educational purposes only and that you should speak with your doctor or other healthcare professional before acting on any such information or commencing any new dietary regime.

By booking into any KULA BODY you confirm that you are not pregnant, injured or suffer from a medical condition, or that you have supplied a medical certificate to state that you are fit to attend any Programs offered by KULA BODY and have discussed your medical condition or pregnancy with your KULA BODY instructor/s prior to your participation in the Program.

You agree to enter and use all the facilities at KULA BODY entirely at your  own risk.  You acknowledge that the activity you may undertake in our Programs is at times a strenuous activity and by participating in it you are exposed to certain risks including injury, or loss or damage to personal property.

Notwithstanding any limitations or restrictions placed on this agreement under the Australian Consumer Law, you acknowledge and agree that KULA BODY shall not have any responsibility or liability to you in respect of any loss or damages you may suffer, directly or indirectly, in connection with your  attendance at or participation in KULA BODY. You further agree to defend, indemnify and hold harmless KULA BODY its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt or expenses (including but not limited to solicitor’s fees) which may be suffered by it or them in connection with your participation in KULA BODY.
